1. Who we are

These Terms & Conditions ("Terms") form a binding agreement between you and HerGrowth ("HerGrowth", "we", "us"), a non-governmental organisation dedicated to connecting underfunded schools with educational grants. These Terms govern your use of our website and any related services (together, the "Services").

By using our website, submitting a grant application, or otherwise engaging with our Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

  • You must be at least 18 years old to use our Services or submit a grant application.
  • If you are acting on behalf of a school or organisation, you warrant that you have authority to bind that organisation to these Terms.
  • Grant applications are open to registered educational institutions based in Africa, the Caribbean, and the Middle East that can demonstrate financial need.

3. Our grant services

HerGrowth facilitates access to educational funding for underfunded schools. We provide:

  • Information about available grants and eligibility criteria.
  • An online application form for schools to submit grant requests.
  • A downloadable grant application document for offline submissions.
  • Email communications regarding application status and decisions.

We are not a financial institution or bank. Submission of a grant application does not guarantee the award of funding. All decisions are made at HerGrowth's sole discretion based on eligibility, need, and available resources.

4. Grant applications

  • All applications are subject to review and may be approved, declined, or deferred.
  • Grant amounts are awarded within the range of $400 to $9,000 USD per application, as determined by HerGrowth based on the information provided.
  • Approved funds must be used solely for the purposes stated in the application. HerGrowth may request evidence of how funds were used.
  • HerGrowth reserves the right to withdraw an approved grant if information provided in the application is found to be false, inaccurate, or misleading.
  • Submission of an application does not create any contractual right to receive funding.

5. Accuracy of information

You are responsible for ensuring that all information submitted in your grant application is accurate, complete, and up to date. Submission of false or misleading information may result in disqualification and, where applicable, recovery of any awarded funds.

6. Intellectual property

Our website, branding, copy, and materials are owned by or licensed to HerGrowth. Nothing in these Terms transfers any intellectual property rights to you. You may not reproduce or distribute our content without prior written permission.

7. Acceptable use

You agree not to:

  • Use our Services for any unlawful or fraudulent purpose.
  • Submit false, misleading, or plagiarised information in a grant application.
  • Share false or defamatory statements about HerGrowth or the schools we support.
  • Attempt to access any part of our systems or data without authorisation.
  • Use our website content, branding, or materials without our prior written consent.

8. Your content

If you submit testimonials, success stories, or other content to us, you grant HerGrowth a non-exclusive, royalty-free licence to use, reproduce, and display that content in connection with our communications and fundraising activities, unless you request otherwise in writing.

9. Disclaimers

Our Services are provided "as is". To the fullest extent permitted by applicable law:

  • We make no warranty that our website will be uninterrupted or error-free.
  • The award of a grant is not guaranteed and is subject to the availability of funds and HerGrowth's assessment of each application.
  • We are not responsible for any loss arising from reliance on information provided on our website.

10. Limitation of liability

Nothing in these Terms limits our liability for fraud, fraudulent misrepresentation, or any liability that cannot be limited under applicable law.

Subject to that:

  • We will not be liable for any indirect or consequential loss arising from your use of our Services.
  • Our total aggregate liability in connection with any grant application is limited to the amount of any grant awarded to you in connection with that application.

11. Governing law

These Terms are governed by applicable law. Any disputes will be resolved through good-faith negotiation in the first instance, and thereafter through the courts of the jurisdiction agreed between the parties.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via our website. Continued use of our Services after changes take effect constitutes your acceptance of the updated Terms.
